(i) Terms & Conditions of Sale and/or Delivery

(a) Private Property Damage Waiver

Southern Mulch is not responsible for any damages to the customers property when delivery is made per customers request after the delivery vehicle leaves a state maintained road.   Additionally, the customer agrees to pay any truck towing expense incurred if were asked to unload in a location our driver determines to be unacceptable.

(b) Delivery Instructions

Southern Mulch relies solely on delivery instructions provided by the customer and makes every reasonable effort to make the delivery within the window of time requested.

(c) Quantity

Southern Mulch guarantees the delivery of the full amount of materials shown on the delivery ticket.  Receipted delivery ticket shall be binding upon the customer, unless disputed within twenty four (24) hours after delivery and shall be a basis for billing.

(d) Public Liability

Customer hereby agrees to hold Southern mulch harmless from any and all liability to the public and customer's employees and subcontractors for any injury or damages caused or contributed to by the material being placed in any particular location, and further agrees to accept full responsibility of placing protective and warning devices.  This paragraph shall become effective at the time the material is placed on the delivery site.

(e) Terms

All approved credit account are due NET 30 following the date of purchase.  Past due accounts will be charged 1.5% (one and one half percent) interest per month (18% annum).  Customers herby agrees to pay reasonable attorney's fees and other collection costs incurred at collection.

(f) Warranties

Southern Mulch has not made and does not make any other warranties, expressed or implied, in connection with this delivery, and there are no conditions, agreements, representations, or obligations between the parties which are not expressed herein.  Southern Mulch makes not warranties for performance of materials furnished when installation or use is beyond our control

(g) Lien Rights

Southern Mulch reserves the right to file a lien on any property where materials are furnished but payment is not received.  A lien may be claimed for all materials, equipment, labor, and services furnished after a date that is eight days, not including Saturdays, Sundays, and other holidays before the receipt of this receipt.  A property owner may be subject to a lien, even if he or she has made full payment to the contractor ordering these materials.  For more information regarding how to protect yourself from the potential lien liability, contact the Construction Contractors Board, an attorney, your contractor, or Southern Mulch.

(ii) Privacy Policy

We will use your information only as permitted by law. However, in trusting us with your personal information, we firmly believe in keeping your personal information private. We reserve the right to occasionally email you with upcoming specials, however:

We will not sell, distribute, or generally make available to any third parties any personally identifying information without your express, voluntary consent (also known as 'opt-in').

Aggregated Information (information that does not personally identify you), however, may be used in many ways. As one example, we may combine information about your usage patterns with similar information obtained from other users to learn which pages are visited most or what features are most attractive. Aggregated Information may occasionally be shared with our advertisers and business partners, but cannot be used to contact you individually.

We may also disclose your information in response to a court order, at other times when we believe we are reasonably required to do so by law, in connection with the collection of amounts you may owe to us, and/or whenever we deem it appropriate or necessary to give such information to law enforcement authorities. Please note we may not provide you with notice prior to disclosure in such cases.

(iii) Content Accuracy

Although we always try to bring you the most pertinent, up to date information around, the southernmulch.com website and related material are provided on an 'as is' basis without any warranties or guarantees of any kind, including timeliness, accuracy of content, or fitness for a particular purpose.
